A builder in Victoria has been ordered to pay an aggregate fine of $100,000 plus legal costs of approximately $20,000 following a prosection brought by the Building Commission for conducting business while not registered, and for carrying out building work before a permit was issued.

In a move designed to send a clear message to the industry, on the 12th June 2012 builder Kadri Saydar was found guilty in the Broadmeadows Magistrates court of 31 charges relating to various breaches of the Building Act 1993 and the Domestic Building Contracts Act 1995.

The charges related to building work carried out at five different properties in Hume and Whittlesea in Victoria.

Building Commissioner, Michael Kefford made clear the Commission’s view on unregistered work.  “This case should send a strong message to the building industry that the Building Commission will hold unregistered builders accountable”, said Mr Kefford. “This is a warning to all individuals operating without the appropriate building registration with the Building Practitioners Board (BPB). If you operate illegally, you will be prosecuted.”

Part of the Building Commission’s role is to oversee registration and the building control system in Victoria to ensure that consumers can expect a high level of quality and protection. 

People engaging a builder are strongly encouraged to ask to see a builder’s warranty insurance for the work they are carrying out, and to ensure that their builder is a registered building practitioner (RBP).
